The privacy of our clients and other individuals is important to us.

These conditions explain how we process personal data within the company Advokátska kancelária SLEZÁK, sro, with its registered office at Adámiho 21, Bratislava 841 05, Slovak Republic, IČO: 52 125 131, registered in the Commercial Register of the District Court Bratislava I, section: Sro, file no. 133425 / B (‘the AKS ‘). AKS respects your privacy and privacy policy. When processing personal data, we are governed primarily by the EU General Data Protection Regulation (“ GDPR ”), which also governs your rights as a data subject, those provisions of the Data Protection Act that apply to us (in particular § 78), (§ 18) as well as other regulations. We adhere to the Code of Conduct adopted by the Slovak Bar Association (“ SAK ”), which explains in more detail the processing of personal data by lawyers. Personal information is any information that may be used to identify you or that is associated with you as a natural person. In particular, we use your personal information in connection with:

  • providing the information you request;
  • using our legal services;
  • using our website.

AKS has the position of an operator in the processing of your personal data, thus determining the purposes and means of processing.

I. PERSONAL DATA WE PROCEED

AKS processes your contact information (email address) and, where applicable, your personally identifiable information (name, surname, employer or affiliation with the organization, company, and other data, if any) (the “ Personal Data ”).

II. WHY YOUR DATA IS PROCESSED

We collect and process your personal data for the purpose of providing legal services, information about your inquiries, legal developments in Slovakia, sending legal news, marketing communications or invitations to events, etc.

We may process your personal information if:

  • this is necessary to fulfill the contract with you or our clients;
  • give your consent for the processing;
  • we consider the processing necessary to achieve our legitimate interests and proceed in accordance with your reasonable expectations and minimum impact on your privacy; or
  • this is required by law or regulation.

We use your personal information to:

  • providing and improving our legal services;
  • maintaining and developing our relationship with you;
  • fulfilling our legal and professional obligations;
  • monitoring and analyzing our business;
  • sending marketing communications if you are our client.

III. WHERE WE HAVE YOUR PERSONAL DATA

If you are our client, we most often collect your personal information directly from you. In this case, the collection of your personal data is voluntary. Depending on the specific case, failure to provide personal information to clients may affect our ability to provide quality legal advice or, in exceptional cases, our obligation to refuse legal advice. We may also obtain personal information about our clients from publicly available sources, from public authorities or from others.

If you are not our client, we collect your personal information most often from our clients or from other public or legal sources by requesting from public authorities, extracting from public registers, obtaining evidence for the benefit of the client and so on. In such a case, we may collect personal information about you without information and against your will, based on our legal authority and the obligation to practice in accordance with the Law on Advocacy.

IV. TO YOUR DATA PROVIDED

We disclose the personal data of our clients and other individuals only to the extent necessary and always in keeping with the confidentiality of the recipient of the data, eg. our employees, the persons we assign to perform individual acts of legal services, representing or cooperating attorneys, our accountants, our professional advisors (eg auditors), the Slovak Bar Association (eg in case of disciplinary proceedings) or providers of software or support of our office , including employees of these persons.

While we have a limited obligation to disclose your personal information to public authorities for confidentiality purposes, we are obliged to prove the commission of a crime and also to disclose information in the areas of money laundering and terrorist financing.

We do not carry out the cross-border transfer of your personal data to third countries outside the European Economic Area (EU, Iceland, Norway and Liechtenstein).

V. HOW LONG WE HAVE YOUR DATA

We only store personal data as long as necessary for the purposes for which the personal data are processed. When storing personal data, we observe the recommended retention periods pursuant to Resolution of the Presidency of the Slovak Bar Association No. 29/11/2011, eg:

  • the incoming and outgoing mail book shall be kept by the lawyer for a period of ten years from the date of receipt or dispatch of the last item entered in the book;
  • the lawyer keeps the inventory list for ten years after it was written;
  • if the lawyer keeps the client’s nomenclature and the client’s file electronically, he / she shall prepare a printed form for the calendar year at the end of the calendar year and store it in the office without time limit;
  • the shredding period of the client file is 10 years and runs from the day when all the conditions for filing the file are met.

Lawyers are subject to professional transcripts interpreting the duties of lawyers under the Act on Advocacy, according to which there are certain circumstances that extend our periods of retention of personal data, respectively. they prevent us from shredding some documents for obvious reasons. eg .:

  • it is not possible to shred a client file containing originals of documents handed over to a lawyer by a client;
  • it is not possible to shred client file logs and client file nomenclature;
  • it is not possible to shred the client file or its part, which the lawyer is obliged to hand over to the state archive;
  • it is not possible to shred the client’s file if any proceedings before the court, state administration body, law enforcement authorities, the Slovak Bar Association, which are related to the content of the client’s file or have been the subject of a lawyer’s failure to provide legal assistance things to the client.

VI. AUTOMATIC DECISION-MAKING AND PROFILING

An automated decision is a decision that is based solely on automated processing, including profiling, that has legal effects or similarly affects you. AKS does not use automatic decision making or profiling to process your personal data.

VII. YOUR RIGHTS

As a client, you have the right to consider access to, and rectification of, your personal data. If we process personal data when providing legal services, you, as a client or other natural person (eg a counterparty), have no right to object to such processing under Article 22 of the GDPR. Where personal data relates to a client (regardless of whether the client is a legal or natural person), neither the right of access to the data nor the right to portability of another person shall, by reason of our legal obligation to maintain confidentiality and with reference to Article 15 (1). Article 20 (4) of the GDPR; 4 GDPR and § 18 para. 8 of the Act on Advocacy: ” The lawyer shall not be obliged to provide information on the processing of personal data, to grant access or portability of personal data under a special regulation if this could lead to a breach of the lawyer’s confidentiality obligation .” protection of personal data or the Slovak Bar Association.

You have the right to access your personal data and information about their processing as well as to correct and complete incomplete data. It is your responsibility to inform AKS in a timely manner about the change of your personal data so that AKS has your correct and complete personal data. To the extent anticipated by GDPR, you are also entitled to their portability.

In justified cases, you may request their deletion or restriction, requesting ACS to remedy the deficiencies or contact the competent supervisory authority.

If the processing of your personal data is based on your consent, you have the right to revoke it at any time without affecting the lawfulness of the processing carried out before its revocation.

You have the right to object at any time to the processing of your personal data for the purpose of direct marketing to the extent that it relates to such direct marketing.
